1. Acceptance of Terms

These Terms and Conditions ("Terms") form a legally binding agreement between you ("User," "you") and L.T.O. Consultants LTD ("Service Provider," "we," "us," "our"), the operator of the "Ogen" ("App"). By accessing, downloading, installing, or using the App, you agree to these Terms. If you do not agree, do not use the App.

2. Description of the App

The App provides self-help psychotherapy exercises, an index of third-party therapists, and an AI-powered chatbot (using Google Gemini technology) for informational and conversational purposes only.

3. Critical Medical and Mental Health Disclaimer

• Not Medical Advice or Treatment: The App is not a medical device, licensed mental health service, substitute for professional therapy, diagnosis, or treatment. Content is for general informational, educational, and self-help purposes only.
• No Professional Relationship: Use of the App, exercises, chatbot, or therapist index does not create any therapist-patient, doctor-patient, or professional relationship.
• Emergencies: In crisis, suicidal thoughts, self-harm, or emergency, immediately contact emergency services (e.g., 100/101/102 in Israel, 911 in US) or a crisis hotline. The chatbot is automated, not monitored, and cannot handle emergencies. We cannot intervene in life-threatening situations.
• Seek Professional Help: Always consult qualified healthcare professionals for mental health concerns. Do not rely on the App for decisions affecting your health.
• AI Limitations: The chatbot may generate inaccurate, incomplete, biased, harmful, or inappropriate responses ("hallucinations"). Do not rely on it for critical decisions.

4. AI Chatbot Specific Terms

• The chatbot is powered by third-party Google Gemini AI.
• Recent conversation messages are stored on our secure servers to provide context across sessions.
• Full chat history is permanently deleted when you delete your account via the "Delete Account" button in the Settings page.
• You acknowledge AI risks and agree not to input highly sensitive personal health data.

5. Therapist Index

• The index lists third-party therapists who self-submit information.
• We do not vet, verify, endorse, license, or guarantee any therapist's credentials, quality, availability, or services.
• We receive no commissions or fees from listings or bookings.
• You are solely responsible for researching, verifying, and selecting therapists. Any engagement is at your own risk.

6. Eligibility

• The App is for users 18 years or older.
• By using the App, you represent you are at least 18 and capable of entering a binding contract.
• Not intended for children; parental supervision advised if accessed by minors.

7. User Conduct and Responsibilities

• Use the App only for personal, non-commercial purposes.
• Prohibited: Illegal activities, harassment, sharing harmful content, attempting to reverse-engineer, or disrupting the App.
• You are responsible for your device security, internet connection, and any data charges.
• We may suspend or terminate access for violations without notice.

8. Intellectual Property

• All content, code, design, and trademarks in the App are owned by us or licensors.
• Limited license: Personal use only. No modification, distribution, or commercial use without permission.

9. Third-Party Services

• The App integrates Google Gemini and may link to third-party sites/services.
• These have separate terms (e.g., Google Gemini Terms of Service, Google Play/App Store terms). You agree to them by use.

10. App Provided "As Is"

• No warranties of accuracy, reliability, or fitness for purpose.
• We may update, modify, or discontinue features without notice.

11. Limitation of Liability

• To the maximum extent permitted by law, we are not liable for any direct, indirect, incidental, consequential, or special damages arising from App use, including reliance on content, AI responses, therapist index, or third-party actions.
• This includes emotional distress, health outcomes, or data loss.

12. Indemnification

• You agree to indemnify us against claims arising from your use of the App or violations of these Terms.

13. Termination

• We may terminate or suspend your access anytime, without notice or liability.
• Upon termination or account deletion, cease use and delete the App.

14. Changes to Terms

• We may update these Terms. Continued use after changes constitutes acceptance. Check periodically.

15. Governing Law

• Governed by laws of the State of Israel, without regard to conflicts of law.
• Exclusive jurisdiction: Courts in Tel Aviv, Israel.

16. Miscellaneous

• If any provision is unenforceable, others remain valid.
• No waiver unless in writing.
